1. About these Terms

These Terms of Use ("Terms") are an agreement between you and Justus Mwanthi, trading as Digital Elimu ("we", "us"). They cover your use of the Digital Elimu software, its online lesson catalogue and any lessons you get through it (together, the "Service").

By installing, activating or using Digital Elimu, you accept these Terms. If you do not accept them, do not use the Service.

If you use Digital Elimu on behalf of a school or other institution, you confirm that you are allowed to accept these Terms for it.

2. Your licence

Digital Elimu is licensed to you. While your licence is active and you follow these Terms, we give you a limited, non-exclusive, non-transferable right to:

  • install and use the software on the number of devices stated with your licence;
  • download lessons from the catalogue and use them for teaching, including presenting them in class.

All other rights are kept by us.

3. Licence codes and activation

  • The software needs a valid reference code to activate. Activation needs an internet connection once; after that, the software works offline.
  • Your reference code is for you only. Do not share, sell or publish it. A code that has been shared may be cancelled without a refund.
  • You are responsible for any use of the software activated with your code.

4. Licence period, expiry and renewal

  • Your licence lasts for the period stated when you bought it, starting from activation.
  • When it expires, the software may run with limited features for a short grace period. After that, it stops working until you renew.
  • Lessons you downloaded remain inside the software and are only available while your licence is active.

5. What you may not do

You may not, and may not allow anyone else to:

  • copy, sell, rent, lend or give away the software or its lessons, except as these Terms allow;
  • reverse-engineer, decompile, modify or try to get the source code of the software;
  • get around, disable or interfere with activation, licensing or any security feature;
  • take lessons out of the software and share or publish them, including uploading them online, printing them for sale or sending them to people without a licence;
  • use the Service for anything unlawful, or in a way that harms the Service or other users;
  • remove or change any copyright or ownership notice.

6. Lessons and content

  • Lessons are owned by us or by the publishers who created them, and are protected by copyright.
  • Only publishers registered and approved by the Digital Elimu administrator can publish lessons. Nobody else can publish to the catalogue. The administrator can suspend or remove any publisher or lesson at any time.
  • Lessons work only inside the Digital Elimu software. They cannot be opened, played or used outside it, and you may not try to copy, export or convert them for use outside the software.
  • You may use lessons to teach, including showing them to learners in class. That use does not transfer ownership of any lesson to you.
  • We may add, change or remove lessons from the catalogue at any time.
  • We work to keep lessons accurate and in line with the CBC curriculum, but you are responsible for checking that a lesson suits your class.

7. Local Sharing

Local Sharing lets licensed devices exchange downloaded lessons over a local network without internet. You may only share lessons with devices that hold an active Digital Elimu licence. Sharing with unlicensed devices breaks these Terms.

8. Updates and online services

  • We may release updates to fix problems, improve security or add features. Some updates may be needed to keep using online features.
  • The online catalogue and other online services depend on the internet and third-party providers. We aim to keep them available, but we do not promise they will always be available or free of errors.

9. Your data

To activate and run the Service, we process limited information: your reference code, activation records and a device identifier. Our Privacy Policy explains what we collect, why, and your rights under Kenya's Data Protection Act, 2019.

10. Ownership

Digital Elimu, including its software, design, database and the lessons we own, is © 2026 Justus Mwanthi (Copyright Reg. No. RZ105835). All rights reserved. The Digital Elimu name and logo may not be used without our written permission.

Third-party components in the software are used under their own licences, listed in the software's notices.

11. Fees and refunds

  • Licence fees are as stated at the time you buy.
  • Fees are non-refundable once the licence has been activated.

12. Suspension and termination

  • We may suspend or end your licence if you break these Terms, for example by sharing your code, redistributing lessons or tampering with the software. If we do this because you broke these Terms, you do not get a refund.
  • You may stop using the Service at any time.
  • When your licence ends, your right to use the software and lessons ends too.

13. No warranty

The Service is provided "as is" and "as available". To the extent the law allows, we make no promises beyond those in these Terms, including that the Service will be uninterrupted, error-free or suitable for a particular purpose. Nothing in these Terms limits any right you have under the Consumer Protection Act, 2012 or any other law that cannot be excluded.

14. Limitation of liability

To the extent the law allows:

  • we are not liable for indirect or consequential loss, or for loss of data, income or opportunity;
  • our total liability to you is limited to the fee you paid for your current licence.

You are responsible for keeping your device secure and in working order.

15. Changes to these Terms

We may update these Terms. The new version will be shown in the software or on digitalelimu.app with its effective date. If you keep using the Service after a change, you accept the new Terms.

16. Governing law

These Terms are governed by the laws of Kenya. Any dispute will be handled by the courts of Kenya.
